Terms of Service

By purchasing any EnzoTrades product, joining our Discord community, or otherwise using our services, you accept these Terms and our associated Privacy Policy, Refund Policy, and Trading Risk Disclosure, each of which is incorporated by reference into these Terms.

You must be at least 18 years old to purchase or use any EnzoTrades product. By purchasing, you represent and warrant that you are at least 18, have the legal capacity to enter into a binding contract, and are not barred from receiving our services under the laws of your jurisdiction.

Our services include:

• Access to the EnzoTrades Discord community (the "Discord")
• Live trading sessions broadcast Monday through Friday at the New York open
• Live charting sessions every Tuesday and Thursday at 7:00 PM ET
• The Asia open session at 8:00 PM ET Monday through Friday, at Enzo's discretion
• The EnzoTrades Custom Indicator (available as an optional add-on)
• The EnzoTrades Trading Course (available as an optional one-time purchase)
• One-on-one mentorship with Enzo (available separately and by application only)

We reserve the right to modify, add, or discontinue any component of these services at any time.

You must provide accurate, complete, and current information at purchase and keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and Discord account. You are responsible for all activity that occurs under your account. Notify us immediately at support@enzotrades.net if you suspect unauthorized use of your account.

You may not share your account, Discord access, indicator license, course access, or any other EnzoTrades product with any other person. Sharing is grounds for immediate termination without refund.

The EnzoTrades Discord is a recurring monthly subscription billed at $97 per month. The Custom Indicator, if purchased, is a recurring monthly add-on billed at $27 per month. The Trading Course, if purchased, is a one-time payment of $247. One-on-one mentorship, if purchased, is a one-time payment of $5,000 unless otherwise agreed in writing.

All subscriptions automatically renew each month on the anniversary of your original purchase date, charged to the payment method on file, until you cancel. You may cancel at any time from your account settings. Cancellation stops future charges but does not entitle you to a refund of the current billing period except as described in our Refund Policy.

Prices are subject to change with 30 days notice to existing subscribers via email.

Refund eligibility and process are governed by our Refund Policy. By purchasing, you agree to be bound by that policy.

All content, materials, videos, session recordings, indicator source code, indicator methodology, chart annotations, written materials, course content, and all other proprietary information created by or for EnzoTrades LLC and Enzo (collectively, "Content") are and remain the exclusive property of EnzoTrades LLC and are protected by copyright, trademark, and other intellectual property laws.

Upon purchase, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Content solely for your own personal, non-commercial use during your active subscription or, for one-time purchases, in accordance with the terms of that specific purchase.

You may not:

• Reproduce, distribute, publicly display, or publicly perform any Content
• Modify, adapt, translate, reverse engineer, decompile, or disassemble the indicator or any software
• Sell, rent, lease, sublicense, or transfer any Content to any third party
• Share your account credentials, Discord access, or product access with any other person
• Record, screen-capture, redistribute, or repost any live session, recording, or private community content outside the EnzoTrades ecosystem
• Use any Content to develop a competing product or service

Violation of any of the above is grounds for immediate termination without refund and may result in legal action.

You agree not to:

• Use our services for any unlawful purpose
• Impersonate any other person or entity
• Harass, threaten, or defame any other user, Enzo, or our team
• Post spam, promotional content, or solicitations for other products or services in the Discord
• Attempt to gain unauthorized access to any portion of our services
• Transmit any virus, malware, or harmful code
• Scrape or automate access to any of our services

The EnzoTrades Discord has its own posted community rules, which are incorporated by reference into these Terms. Violation of the community rules is grounds for warning, temporary suspension, or permanent removal from the Discord at our sole discretion. Removal from the Discord for community rules violations does not entitle you to a refund.

You may terminate your account at any time by cancelling your subscription from your account settings or by emailing support@enzotrades.net.

We may terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, non-payment, chargeback initiation, fraudulent activity, sharing of account access, or conduct we determine in our sole discretion to be harmful to the community or the business.

Upon termination, your license to use all Content is immediately revoked. Access to the Discord, indicator, course, and all other products will be removed.

Your use of our services is subject to our Trading Risk Disclosure. You acknowledge that you have read, understood, and agreed to the Trading Risk Disclosure in full.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT ANY CONTENT, INDICATOR LEVEL, TRADE SETUP, MARKET CALL, OR EDUCATIONAL MATERIAL WILL RESULT IN PROFIT OR AVOID LOSS. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY MARKET DATA, PRICE LEVEL, OR TRADING SIGNAL.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENZOTRADES LLC, ENZO PERSONALLY, OR ANY OF OUR OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

(a) ANY TRADING LOSSES, LOST PROFITS, MISSED OPPORTUNITIES, TAX CONSEQUENCES, PROP FIRM DRAWDOWN VIOLATIONS, ACCOUNT TERMINATIONS, BLOWN EVALUATIONS, OR ANY OTHER FINANCIAL LOSSES OF ANY KIND RESULTING FROM YOUR USE OF OUR SERVICES OR YOUR TRADING DECISIONS, WHETHER OR NOT INFORMED BY OUR CONTENT;

(b) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR

(c) ANY DAMAGES ARISING FROM DELAY, INTERRUPTION, OR UNAVAILABILITY OF OUR SERVICES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless EnzoTrades LLC, Enzo personally, and our officers, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your access to or use of our services
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any trading decision you make, including but not limited to trading losses, prop firm violations, and tax consequences
• Any claim that your trading activity was informed, directed, or encouraged by our Content

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of our services, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that you may bring an individual claim in small claims court if it qualifies.

The arbitration shall take place in Florida or, at your election, remotely. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

BY AGREEING TO THESE TERMS YOU AND WE ARE EACH WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

You and EnzoTrades LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and we each waive any right to a jury trial. You may not act as a class representative or participate as a member of a class of claimants with respect to any claim.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you by email or by prominent notice on our website at least 14 days before the changes take effect. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms.
